East Coast Auto Broker & Transportation d/b/a AutoShip365
Terms & Conditions
Please read these Terms & Conditions carefully before requesting a quote, booking transportation, making payment, or otherwise using our services.
Last updated: September 20, 2026
Important — Your Acceptance of These Terms
These Terms & Conditions form a legally binding agreement between you and East Coast Auto Broker & Transportation, doing business as AutoShip365.
By accessing or using our website, requesting a quote, submitting a transportation request, electronically accepting an order, providing payment information, authorizing transportation, signing electronically, or otherwise using our services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms & Conditions in their entirety.
If you do not agree to every provision of these Terms & Conditions, you may not use our services, submit a transportation order, book a shipment, or otherwise engage AutoShip365 to arrange transportation on your behalf.
Your electronic acceptance, checkbox selection, electronic signature, payment authorization, email or text authorization, or continued use of our services may constitute your acceptance of this Agreement to the fullest extent permitted by applicable law.
1. Business Identity and Trade Name
For purposes of these Terms & Conditions, East Coast Auto Broker & Transportation is the underlying contracting business and operates under the trade name or DBA AutoShip365.
References throughout this Agreement to “AutoShip365,” “East Coast,” “East Coast Auto Broker & Transportation,” “Company,” “we,” “our,” or “us” refer to the same underlying business entity unless expressly stated otherwise.
AutoShip365 is a trade name and is not intended to represent a separate legal entity from East Coast Auto Broker & Transportation. Any quote, booking, transportation arrangement, invoice, payment, website transaction, communication, or service offered under the AutoShip365 name is entered into with and provided by the underlying business.
2. Scope of Agreement
These Terms govern your use of our websites, forms, quote systems, transportation brokerage services, booking systems, payment systems, communications, customer portals, shipment coordination services, and any vehicle or other approved transportation arranged through us.
These Terms apply to individual consumers, dealerships, auto auctions, vehicle brokers, fleet operators, rental companies, financial institutions, businesses, and other commercial customers unless a separate written agreement signed by the Company expressly provides otherwise.
3. We Arrange Transportation as a Broker
Except where expressly agreed otherwise in writing, AutoShip365 acts as a transportation broker. Our role is to arrange transportation by connecting customers with independent motor carriers that physically transport vehicles or other approved property.
Unless specifically stated otherwise in writing, AutoShip365 does not own or operate the truck, trailer, or transportation equipment used to physically transport your vehicle.
The motor carrier assigned to a shipment is an independent business and is responsible for its drivers, equipment, loading and unloading practices, route selection, securement decisions, compliance obligations, and physical transportation of the vehicle while the vehicle is in the carrier’s possession or control.
Nothing in these Terms creates an employment, partnership, franchise, joint venture, or agency relationship between AutoShip365 and an independently contracted motor carrier.
4. Carrier Selection and Vetting
AutoShip365 may review information concerning a prospective carrier’s operating authority, registration, insurance information, safety information, reputation, and transportation history before assigning that carrier to a shipment.
Carrier screening is intended to assist us in selecting transportation providers but does not constitute a guarantee concerning a carrier’s future conduct, performance, financial condition, insurance coverage, claims handling, equipment condition, driver conduct, or ability to complete a shipment without delay or incident.
AutoShip365 reserves the right to reject, replace, or reassign a carrier when reasonably necessary because of scheduling, safety, insurance, authority, mechanical, operational, compliance, or customer-service concerns.
5. Quotes, Estimates and Final Pricing
Any instant website price, automated estimate, preliminary quote, verbal estimate, or other estimated transportation price is not a guaranteed final price unless AutoShip365 expressly identifies it in writing as a confirmed transportation price.
Transportation pricing may be affected by factors including:
- Pickup and delivery locations;
- Transportation distance;
- Vehicle year, make, model, dimensions, weight, and condition;
- Open or enclosed transportation;
- Whether the vehicle is operable;
- Lifted, lowered, modified, oversized, specialty, exotic, classic, or luxury vehicles;
- Fuel prices;
- Seasonal transportation demand;
- Carrier availability;
- Route conditions and accessibility;
- Pickup or delivery deadlines;
- Auction or dealership procedures;
- Port or terminal requirements;
- Special loading equipment; and
- Other circumstances that affect the cost or difficulty of transportation.
If the information supplied by the Customer is inaccurate, incomplete, or changes before pickup, the transportation price may be adjusted to reflect the actual services required.
Submitting a quote request does not itself guarantee carrier availability or create an obligation for AutoShip365 to provide transportation.
6. Customer Representations and Accurate Information
You represent and warrant that all information you provide in connection with a transportation request is complete and accurate to the best of your knowledge.
You further represent that you are either the lawful owner of the vehicle or have sufficient authorization from the lawful owner to arrange transportation and enter into this Agreement.
You must disclose conditions that may affect transportation, including but not limited to:
- Inoperable or partially operable condition;
- Known mechanical issues;
- Fluid leaks;
- Lift kits;
- Lowered suspension;
- Oversized wheels or tires;
- Roof racks or aftermarket accessories;
- Modified body components;
- Missing keys;
- Locked steering;
- Collision or structural damage;
- Non-factory dimensions or weight; and
- Any other condition affecting loading, unloading, clearance, weight, securement, or transportation.
The Customer may be responsible for additional charges or failed pickup expenses caused by inaccurate, incomplete, or undisclosed information.
7. Carrier Assignment
AutoShip365 will use commercially reasonable efforts to locate an appropriate carrier for an accepted transportation request. Carrier availability is not guaranteed.
A carrier may decline or cancel a shipment based on route, vehicle condition, equipment limitations, timing, safety considerations, pricing, weather, mechanical conditions, or other operational circumstances.
If an assigned carrier becomes unavailable, AutoShip365 may attempt to locate a replacement carrier.
8. Pickup and Delivery Dates Are Estimates
Unless expressly guaranteed in a separate written agreement signed by AutoShip365, all pickup dates, pickup windows, transit times, estimated arrival times, and delivery dates are estimates only and are not guaranteed.
Transportation schedules may be affected by traffic, weather, accidents, road closures, government inspections, driver hours-of-service requirements, mechanical breakdowns, loading delays, customer delays, other shipments, holidays, natural disasters, or circumstances outside the reasonable control of AutoShip365.
Customers should not schedule flights, vehicle sales, repair appointments, hotel reservations, relocation deadlines, business commitments, vacations, or other time-sensitive obligations based solely upon an estimated pickup or delivery date.
To the fullest extent permitted by law, AutoShip365 is not responsible for rental-car charges, airfare, hotels, missed appointments, loss of use, lost income, lost profits, or other consequential expenses resulting from transportation delays.
9. Door-to-Door Service
“Door-to-door” transportation means that the motor carrier will attempt to pick up and deliver the vehicle as close as reasonably and legally possible to the requested addresses.
Transport trucks may be unable to safely or legally access certain residential streets, gated communities, apartment complexes, cul-de-sacs, narrow roads, low-clearance areas, roads with low-hanging trees, steep grades, weight-restricted roads, or congested locations.
If direct access is impractical or unsafe, the Customer and carrier may arrange a nearby accessible location such as a large parking lot, shopping center, or other suitable meeting location.
10. Preparing Your Vehicle for Transportation
Before pickup, the Customer is responsible for preparing the vehicle for transportation. Unless the carrier instructs otherwise, the Customer should:
- Remove valuables and prohibited personal property;
- Remove or secure loose exterior accessories;
- Secure convertible tops and removable components;
- Retract or remove antennas where practical;
- Disable alarms or provide instructions for disabling them;
- Provide all keys required to access and operate the vehicle;
- Ensure tires are reasonably inflated;
- Disclose known fluid leaks;
- Maintain only a reasonable amount of fuel;
- Remove or disable toll transponders where appropriate; and
- Ensure electric or hybrid vehicles have sufficient battery charge for loading and unloading.
11. Inoperable and Specialty Vehicles
A vehicle represented as operable should ordinarily be capable of starting, steering, rolling, braking, and being safely loaded and unloaded under its own power.
Inoperable vehicles and vehicles requiring special equipment must be disclosed before carrier assignment.
Additional fees may apply for winching, forklifts, oversized vehicles, modified vehicles, non-rolling vehicles, vehicles without keys, locked steering, or other special loading requirements.
12. Personal Property Inside Vehicles
AutoShip365 arranges vehicle transportation and is not acting as a household-goods mover.
Customers should not place personal property inside a vehicle unless the assigned carrier expressly permits it.
Any personal property accepted by a carrier is subject to that carrier’s policies, weight restrictions, insurance limitations, and applicable law.
Unless expressly confirmed otherwise in writing, personal property placed inside a vehicle is not insured by AutoShip365, and AutoShip365 assumes no responsibility for loss, theft, damage, confiscation, or destruction of such property.
13. Prohibited Items
You may not knowingly place hazardous materials, explosives, illegal drugs, contraband, unlawful property, dangerous chemicals, perishable goods, live animals, or other unlawful or hazardous materials inside a transported vehicle.
The Customer is responsible for consequences resulting from prohibited or undisclosed contents placed in the vehicle.
14. Dealer, Auction and Fleet Transportation
For dealership, auction, fleet, dealer-to-dealer, commercial, repossession-release, or similar transportation, the Customer is responsible for ensuring all required documentation and access information are available before carrier arrival.
This may include buyer numbers, lot numbers, gate passes, release forms, stock numbers, keys, authorization documents, titles when required, pickup numbers, and facility instructions.
AutoShip365 is not responsible for auction fees, storage charges, gate fees, late-release fees, failed pickup fees, or similar expenses caused by missing documents, inaccurate information, inaccessible vehicles, facility closures, customer delays, or circumstances outside our reasonable control.
15. Payment Terms
The Customer agrees to pay all charges accepted in connection with a transportation order, including applicable brokerage charges, carrier transportation charges, agreed surcharges, accessorial charges, cancellation charges, and other amounts properly incurred in connection with the transportation arrangement.
The payment structure may vary by shipment. Your quote, booking confirmation, invoice, dispatch confirmation, or other written documentation may identify amounts payable to AutoShip365 and amounts payable directly to the motor carrier.
By providing a payment method, you authorize AutoShip365 and its payment processors to process amounts that you have agreed to pay.
You are responsible for providing accurate billing information and maintaining sufficient funds or credit for authorized charges.
16. Cancellation and Refunds
Cancellation and refund rights may depend upon the status of the transportation order, including whether a carrier has been assigned, accepted the order, begun traveling to the pickup location, or incurred expenses in connection with the shipment.
Any cancellation charge, brokerage fee, administrative fee, deposit treatment, or refund condition disclosed in the accepted quote, booking confirmation, invoice, dispatch confirmation, or other order documentation is incorporated into this Agreement.
If a carrier has already been assigned or dispatched, fees may already have been earned or costs incurred. AutoShip365 may retain or deduct properly disclosed and earned amounts subject to applicable law.
17. Chargebacks and Payment Disputes
If you believe a charge is incorrect, you agree to contact AutoShip365 promptly and provide a reasonable opportunity for us to investigate and attempt to resolve the issue.
Nothing in this Agreement eliminates rights you may lawfully have through your bank or payment-card provider.
However, initiating a knowingly false, fraudulent, or improper chargeback or payment dispute does not eliminate amounts legitimately owed under this Agreement, and AutoShip365 reserves all lawful rights to recover such amounts and related costs where permitted.
18. Vehicle Inspection and Bill of Lading
The Customer or an authorized representative should inspect the vehicle with the motor carrier at pickup and delivery.
The carrier may prepare a Bill of Lading (“BOL”), vehicle condition report, electronic inspection, or similar documentation recording the condition of the vehicle.
At delivery, the Customer should inspect the vehicle before signing the final delivery documentation whenever reasonably possible.
Any newly observed damage should be immediately identified to the carrier and documented on the Bill of Lading or delivery inspection. Photographs or video should be taken whenever practicable.
Signing a delivery document without identifying visible damage may affect the ability to establish a subsequent damage claim.
19. Carrier Insurance and Damage Claims
Because an independent motor carrier physically transports the vehicle, claims for physical loss or damage occurring while the vehicle is in the carrier’s custody will ordinarily be directed to the motor carrier and, where applicable, its insurance provider.
AutoShip365 is not the motor carrier’s insurance company and does not act as the motor carrier’s claims adjuster or guarantor of insurance coverage.
If a damage issue arises, AutoShip365 may provide reasonable administrative assistance, including supplying available carrier contact information, insurance information, shipment records, or other available documentation.
Providing such assistance does not constitute an admission of liability and does not make AutoShip365 responsible for the motor carrier’s acts, omissions, insurance deductible, coverage decisions, claim decisions, delays, denials, settlement amounts, or payment.
The Customer remains responsible for preserving evidence and complying with applicable claim procedures and deadlines.
20. Optional Supplemental Protection or Insurance Products
AutoShip365 may make optional third-party supplemental insurance, transportation protection, coverage, or similar products available to eligible customers.
Unless expressly stated otherwise, these products are separate from our transportation brokerage service and may be offered, issued, administered, underwritten, or provided by an independent third party.
Any optional product is governed by its own policy, certificate, terms, exclusions, limits, deductibles, eligibility requirements, and claims procedures.
If there is a conflict between these Terms and the actual policy or protection contract concerning coverage, the applicable insurance or protection agreement controls with respect to that coverage.
Purchasing optional coverage does not change AutoShip365’s role as a transportation broker unless expressly stated otherwise in writing.
21. Mechanical and Pre-Existing Conditions
Neither AutoShip365 nor the motor carrier is responsible for normal mechanical failures or pre-existing mechanical, electrical, structural, or operational conditions that were not caused by transportation.
Transportation may reveal pre-existing weakness in components such as batteries, tires, suspension, convertible tops, antennas, spoilers, aftermarket parts, or other components.
Damage caused by a proven negligent act during transportation remains subject to the applicable carrier claims process and applicable law.
22. Limitation of Liability
To the fullest extent permitted by applicable law, AutoShip365 will not be liable for the acts or omissions of independent motor carriers, including loss or damage occurring while a vehicle is in the carrier’s custody, except to the extent liability is imposed directly upon AutoShip365 by applicable law and cannot lawfully be waived or limited.
To the fullest extent permitted by law, AutoShip365 shall not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including:
- Loss of use;
- Lost profits;
- Lost income or revenue;
- Lost business opportunities;
- Rental vehicle expenses;
- Hotels or airfare;
- Missed appointments;
- Business interruption;
- Emotional distress;
- Consequential storage expenses; or
- Other consequential or indirect losses.
To the fullest extent permitted by applicable law, AutoShip365’s aggregate liability arising from its own brokerage services shall not exceed the brokerage or service fee actually paid to AutoShip365 for the shipment giving rise to the claim.
Nothing in these Terms limits or excludes liability that applicable law does not permit to be limited or excluded.
23. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless AutoShip365, East Coast Auto Broker & Transportation, and their owners, employees, agents, representatives, and affiliates from third-party claims, losses, liabilities, damages, penalties, fines, costs, and reasonable expenses arising from:
- Materially inaccurate information provided by you;
- Your lack of lawful authority to ship a vehicle;
- Illegal, hazardous, or prohibited property placed in a vehicle;
- Your violation of applicable law;
- Your material breach of this Agreement; or
- Your negligent or wrongful acts or omissions that cause injury, loss, expense, or delay.
This provision does not require you to indemnify AutoShip365 for liability that applicable law prohibits AutoShip365 from transferring or disclaiming.
24. Events Beyond Our Reasonable Control
AutoShip365 shall not be responsible for failure or delay in performance caused by circumstances beyond its reasonable control, including severe weather, hurricanes, tornadoes, flooding, fires, natural disasters, road closures, accidents, government actions, inspections, civil disturbances, war, terrorism, strikes, labor shortages, fuel shortages, cyber incidents, communications failures, port closures, carrier equipment failure, or similar events.
25. Communications by Phone, Email and Text
By providing your contact information in connection with a quote or transportation request, you authorize AutoShip365 to contact you regarding that request or shipment by telephone, email, and text message using the contact information you provide.
Communications may include quotes, carrier assignments, scheduling information, pickup and delivery coordination, shipment-status updates, payment information, documentation requests, support communications, and other transactional messages related to services you requested.
Message and data rates may apply.
Marketing communications, where applicable, are subject to applicable consent requirements and any additional disclosure presented when your information is collected.
Calls may be monitored or recorded where permitted by applicable law for quality assurance, documentation, training, security, and dispute-resolution purposes.
26. Electronic Communications, Records and Signatures
You consent to receiving contracts, disclosures, notices, invoices, quotes, order confirmations, authorizations, and other records electronically where permitted by law.
To the fullest extent permitted by law, an electronic signature, electronic checkbox, electronic acceptance, email authorization, text authorization, payment authorization, or other electronic indication of agreement may have the same legal effect as a handwritten signature.
27. Website Use
We make reasonable efforts to maintain accurate information on our website but do not warrant that website information will always be complete, current, or error-free.
Transportation prices, service areas, carrier availability, transit estimates, routes, schedules, and other information may change without notice.
You may not use our website or systems to engage in fraud, impersonate another person, interfere with our systems, attempt unauthorized access, transmit malicious code, scrape protected information unlawfully, submit knowingly false information, or engage in unlawful activity.
28. Third-Party Services
Our website and transportation services may interact with third-party payment processors, insurance providers, mapping services, dispatch systems, communication providers, review platforms, transportation management systems, carriers, load boards, and other external services.
AutoShip365 is not responsible for the independent content, availability, terms, security, performance, or privacy practices of third-party providers.
Your use of a third-party service may also be governed by that provider’s separate terms and policies.
29. Privacy
Our collection, use, retention, and disclosure of personal information are also governed by our Privacy Policy.
By using our website or services, you acknowledge that you have had an opportunity to review our Privacy Policy.
30. Governing Law and Exclusive Gwinnett County Forum
This Agreement and any dispute arising out of or relating to this Agreement, our website, a quote, transportation order, payment, shipment, brokerage service, communication, or the relationship between you and AutoShip365 shall be governed by the laws of the State of Georgia, without regard to conflict-of-law principles, except where controlling federal law applies.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND AUTOShip365 EXPRESSLY, KNOWINGLY, AND VOLUNTARILY AGREE THAT ANY LAWSUIT, ACTION, CLAIM, OR JUDICIAL PROCEEDING ARISING OUT OF OR RELATING TO THESE TERMS, YOUR USE OF THIS WEBSITE, ANY QUOTE, BOOKING, TRANSPORTATION ORDER, SHIPMENT, PAYMENT, TRANSPORTATION SERVICE, OR OTHER TRANSACTION WITH AUTOShip365 SHALL BE FILED AND MAINTAINED EXCLUSIVELY IN A COURT OF COMPETENT JURISDICTION LOCATED IN GWINNETT COUNTY, GEORGIA.
YOU EXPRESSLY CONSENT TO THE PERSONAL JURISDICTION AND VENUE OF SUCH COURTS AND, TO THE FULLEST EXTENT PERMITTED BY LAW, WAIVE ANY OBJECTION BASED UPON IMPROPER VENUE, INCONVENIENT FORUM, OR LACK OF PERSONAL JURISDICTION.
If controlling federal law requires a particular claim to be filed in federal court or otherwise establishes exclusive federal jurisdiction, the parties agree, to the fullest extent permitted by law, that such proceeding shall be filed in the federal court having jurisdiction over Gwinnett County, Georgia.
31. Good-Faith Attempt to Resolve Disputes
Before filing a lawsuit, the parties are encouraged to make a reasonable good-faith effort to resolve the dispute directly.
A Customer asserting a dispute should provide reasonable written notice identifying the transportation order or shipment, the nature of the dispute, the amount claimed if applicable, relevant documentation, and the resolution requested.
Nothing in this provision prevents either party from seeking immediate judicial relief when necessary to protect legal rights, preserve evidence, satisfy a legal deadline, or prevent imminent harm.
32. Entire Agreement
These Terms, together with the applicable quote, accepted transportation order, dispatch confirmation, invoice, Bill of Lading where applicable, Privacy Policy, and other documents expressly incorporated into the transaction, constitute the agreement governing the applicable services.
If a separately signed written agreement between AutoShip365 and the Customer expressly conflicts with these Terms, the specifically negotiated provision of that signed agreement will control to the extent of the conflict.
33. Severability
If a provision of these Terms is determined by a court of competent jurisdiction to be invalid, unlawful, or unenforceable, that provision shall be enforced to the maximum extent permitted by law or severed to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
34. No Waiver
Failure by AutoShip365 to enforce any provision of these Terms on one occasion shall not constitute a waiver of our right to enforce that provision or any other provision in the future.
35. Assignment
You may not assign or transfer your rights or obligations under a transportation order without our written consent.
AutoShip365 may assign its rights or obligations in connection with a lawful merger, acquisition, business restructuring, financing transaction, sale of substantially all relevant assets, or similar business transaction.
36. Changes to These Terms
AutoShip365 may update these Terms from time to time. When changes are made, the “Last updated” date at the top of this page will be revised.
Changes generally apply prospectively unless applicable law permits otherwise.
The version applicable to a particular transportation transaction will ordinarily be the version accepted in connection with that transaction, together with any subsequent modification expressly accepted by the parties.
